Company: PROMFREE LLC, identification number in the Entrepreneurial Register of Georgia: 445849486, Georgia (hereinafter — the Company).
This Agreement defines the general terms of use of the Service by Clients (customers of services).
By continuing to use the Service, you agree to the terms of this Agreement and all related documents (the Personal Data Processing Policy, the Dispute Resolution Policy, etc.).
The Agreement is deemed concluded in Batumi, Georgia, from the moment of acceptance (registration, posting an order, making a payment, etc.).
1. Definitions
Client — an individual or legal entity posting an order for the provision of services through the Service.
Specialist — a user offering services through the Service.
Order — a paid service contract concluded directly between the Client and the Specialist.
The Company is not a party to the contract between the Client and the Specialist.
2. Subject of the Agreement
The Company provides the Client with access to the Service for posting orders, searching for Specialists, communication, and using the «Secure Deal» service.
3. Rights and obligations of the Client
The Client is obliged to:
- Provide accurate information when registering and posting orders.
- Pay for the Specialist’s services in a timely manner (via the «Secure Deal» or directly).
- Accept completed work within a reasonable time.
- Comply with the legislation of Georgia and the rules of the Service.
The Client has the right to:
- Post orders and choose Specialists.
- Use the «Secure Deal» service to protect their interests.
- Contact support in the event of disputes.
4. The «Secure Deal»
When using the «Secure Deal», payment is made to the account of a licensed Partner Bank. The Company does not hold the Client’s funds.
Funds are transferred to the Specialist after the work is confirmed as completed and accepted by the Client.
5. Liability
The Company is not responsible for the quality of services provided by Specialists or for the performance of contracts between the Client and the Specialist.
The Client is responsible for the accuracy of the information posted and for compliance with the legislation of Georgia.
The Specialist is an independent contractor. The Company is not the Specialist’s employer, is not in an employment relationship with the Specialist, and bears no responsibility for the payment by the Specialist of taxes, insurance contributions and other mandatory payments. The Specialist is solely and fully responsible for compliance with the tax laws of the country of their residence and/or the country where the services are provided.
6. Personal data
The Client’s personal data is processed in accordance with the Personal Data Processing and Privacy Policy.
7. Termination and amendment of the Agreement
The Client may terminate the Agreement at any time by deleting their account.
The Company has the right to amend the Agreement with notice through the Service.
8. Applicable law and jurisdiction
The Agreement is governed by the legislation of Georgia. All disputes are considered by the courts of Batumi, Georgia.
